1. LIMITED WARRANTY
The Company warrants that the Stand Up Paddle Board will perform substantially in accordance with the accompanying written materials for a period of One Year from the date of receipt and (b) that the item purchased will be free from defects in materials and workmanship under normal use and service for a period of one year. This is not inclusive of User Error or Negligence by the customer. In the event applicable law imposes any implied warranties, the implied warranty period is limited to one year from the date of receipt.
2. CUSTOMER REMEDIES
The Company's and its suppliers' entire liability and Customer's exclusive remedy shall be, at the Company's option, either (a) Exchange of the product for the same or similar item, or (b) repair or replacement of the item which includes the items purchased from the Company such as Stand Up Paddle Board and Accessories. Customer must retain receipt of purchase and/ or warranty information. This Limited Warranty is void of the damage has resulted from accident, abuse, negligence, misuse, or user error of the item. Any replacement item will be warranted for the remainder of the original warry period or sixty 60 days, whichever is longer.
3. NEGLIGENCE, ABUSE, AND MISUSE OF THE ITEM
Antidote Paddle Boards, Inc. recommends that proper care for the item is taken. Stand up paddle boards are made of fiberglass and should be cared for as any other glass. The item should be stored indoors in a properly ventilated area and away from extreme weather conditions. The item should be out of direct sunlight unless on the water and when transported the item should be in a sun resistant board bag. Too much sun or heat exposure can damage the fiberglass and case the board to "warp" or "de-laminate". If proper care is taken such as indoor storage and transportation in a sun resistant board bag, delamination will not occur.
In the event that it does occur even with proper care for the item Antidote Paddle Boards, Inc. will replace the item with a brand new board within the warranty period. Board damage due to too much sun or heat exposure, as well as damage due to hitting the board against
a hard surface or dropping the board will not be covered under the warranty. CRASHING INTO ROCKS, DOCS, SAND OR BOATS IS NOT COVERED UNDER THE WARRANTY. Standing on the paddle board when not on the water is considered misuse and not covered under warranty. Be sure to take the fins off and/or be sure the fins are fully submerged under water and not in the sand before standing on the paddle board.
4. NO OTHER WARRANTIES
To the maximum extent permitted by applicable law, the company and its suppliers disclaim all other warranties, either expressed or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose, with regard to the paddle board and any related written materials. This limited warranty gives the customer specific legal rights. Customer may have other rights depending on the jurisdiction.
5. NO LIABILITY FOR DAMAGES To the maximum extent permitted by applicable law, in no event shall the company or its suppliers be liable for any damages whatsoever (including without limitation, special, incidental, consequential, or indirect damages for personal injury, loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product. Even if the company has been advised of the possibility of such damages. In any case, the company's and its suppliers' entire amount of liability under any provision of this agreement shall be limited to the amount actually paid by the customer for the paddle board.
